BIRDCALL SCRATCH-OFF SWEEPSTAKES OFFICIAL RULES

No purchase or payment of any kind necessary to enter or win. A purchase or payment will not increase your chances of winning. Void where prohibited. Must be 18 years of age or older to participate.

1. SPONSOR: Sponsored by Birdcall, LLC (“Sponsor”), 855 Wyandot St. Suite 102 Denver, CO 80204. 
2. ELIGIBILITY: Open only to legal residents of Colorado, Arizona, and Texas who are 18 years of age or older at time of entry. Employees of Sponsor, their immediate families (spouse, parents, siblings, children), and household members are ineligible. Subject to all federal, state, and local laws. 
3. PROMOTION PERIOD: Begins 3,545[Start Date, 12:01 a.m. MT on 12/26/2025] and ends [End Date, 11:59 p.m. MT on 2/28/2026] (“Promotion Period”). Sponsor’s clock is official timekeeper.
4. HOW TO ENTER:
   
   1. Free In-Store Method (No Purchase Necessary): During Promotion Period, visit any participating Birdcall location in CO, AZ, or TX during regular hours and request one (1) free Scratch-Off Card from a team member (limit 1 per person/day; must be present to receive). Scratch the card to reveal if you’ve won an Instant Prize (revealed immediately). Void if altered/tampered.
   2. Free with purchase: During Promotion Period, visit any participating Birdcall location in CO, AZ, or TX during regular hours and one (1) free Scratch-Off Card will be added to any purchase (limit 1 per person/day; must be present to receive). Scratch the card to reveal if you’ve won an Instant Prize (revealed immediately). Void if altered/tampered.
   3. Entry Limits: One (1) entry per person/day; max 1 prize per person/household during Promotion Period. Multiple entries from same person/email/address disqualify all.
   4. All methods of obtaining a Scratch-Off Card (whether received with a purchase or requested free in-store) are part of the same prize pool and have identical odds of winning any prize. The promotion is structured so that purchasing (or not purchasing) does not increase or decrease your odds of winning.

Odds: 1:30,000 for any Instant Prize (based on 30,000 total cards distributed; subject to change). All prices are non-transferable; no cash substitution except at Sponsor’s discretion.
6. WINNER SELECTION & NOTIFICATION: Instant Win: Reveal on card at entry. For non-instant (e.g., cash or gift card): Random draw from all eligible entries within 7 days post-Promotion Period. Potential winners must submit contact information and image of winning card to info@eatbirdcall.com within entry period (CO: C.R.S. § 6-1-803(2)); Birdcall must respond within 5 days with affidavit of eligibility, tax forms (for cash >$600), and ID. Unclaimed prizes forfeited. 
7. TAXES & REPORTING: All federal, state, and local taxes, fees, and surcharges on prizes are the sole responsibility of the prize winner. Winners of prizes valued at $600 or more will be issued an IRS Form 1099-MISC (or equivalent) for the calendar year in which the prize is awarded. For any cash prize of $600 or more, Sponsor may withhold applicable federal and state taxes as required by law before issuing payment (currently 24% federal backup withholding if winner fails to provide a valid SSN/TIN). Failure to provide a valid Social Security Number or complete required tax documentation within the specified timeframe will result in prize forfeiture. Non-cash prizes (gift cards, shake credit, BOGO, $5 off) have no tax withholding by Sponsor, but winners remain responsible for reporting the fair market value as income.
8. GENERAL CONDITIONS: By entering, you agree to these Official Rules and Sponsor’s decisions (final). Sponsor not responsible for lost/stolen cards, technical errors, or entries not received. Prizes awarded “AS IS”; no warranties. Entrants grant Sponsor perpetual, royalty-free license to use name/likeness for publicity (except where prohibited). RELEASE: Release Sponsor and affiliates from any liability related to participation/prizes. Disputes governed by laws of Colorado (venue: Denver County).

10. Dispute Resolution and Venue: Except where prohibited, any dispute arising under these Official Rules shall be resolved individually by binding arbitration under AAA rules or in small claims court if eligible, with arbitration held in Denver County, Colorado, under Colorado law, and no class actions or jury trials permitted.
